Introduction and acceptance
By using The Energy Insight Pilot website, account portal, emails, text messages, or related pilot services, you agree to these Terms of Service. If you do not agree, please do not use the service.
These Terms apply to pilot participants and anyone who uses the website or account portal. They work together with the Privacy Policy and the Text Message Terms.
About the service
The Energy Insight Pilot is a residential energy monitoring and time-of-use readiness pilot. We use authorized utility data to provide educational usage-timing insights, account updates, and pilot communications by email and optional SMS.
Participation is by invitation or enrollment only. The pilot does not change your utility account, utility service, meter, bill, supplier, or rate plan.
Eligibility
You must be at least 18 years old, live in the United States, and be the authorized utility account holder or have permission from the account holder to connect the utility account.
Full service access is available only to participants who complete enrollment and authorize Bayou Energy or a successor provider to retrieve utility account data on their behalf.
Data and privacy
Our collection and use of participant data is described in the Privacy Policy. By enrolling, you authorize Bayou Energy or a successor provider to retrieve smart meter data, billing summary data, and related utility account information on your behalf so we can provide the service.
You can revoke utility data authorization at any time by contacting support@energyinsightpilot.com. Revocation may limit or end our ability to provide personalized insights.
SMS and communications
We may send energy insights, account updates, pilot notices, support messages, and surveys by email. If you separately consent to SMS, we may also send pilot text messages. Full SMS consent terms are available in the Text Message Terms.
You can opt out of SMS by replying STOP to a pilot text message. You can use the unsubscribe link in an email when one is provided, or contact support for help with communication preferences.
Intellectual property
The pilot website, account portal, reports, analysis formats, text, graphics, and service content are owned by the pilot operator or its licensors. You may use pilot materials for your personal household review, but you may not copy, sell, or reuse them as a competing service.
You retain ownership of your personal data, utility usage data, and information you provide. You grant us a limited license to process that information only as needed to operate, improve, secure, and support the pilot.
Third-party services
The service depends on third-party systems, including Bayou Energy for utility data retrieval, utility websites and APIs, email providers, website hosting, and Twilio or successor providers for SMS delivery. Those providers may have their own terms and privacy practices.
Utility data imports, billing summaries, account-connection status, monitoring insights, emails, and text messages may be delayed, interrupted, incomplete, blocked, filtered, throttled, or unavailable if those third-party systems change, fail, rate-limit access, return incomplete data, or experience outages.
Disclaimer of warranties
We provide The Energy Insight Pilot as is and as available. We do not guarantee that the service will be uninterrupted, error-free, secure, or available at any particular time. We do not guarantee that utility data, billing data, alerts, emails, or text messages will always arrive on time or be complete.
Energy insights are educational and informational. They are not professional energy, legal, tax, financial, engineering, or utility-service advice. You should not rely on the pilot for emergencies, utility outage reporting, billing disputes, account security notices, or other time-sensitive utility service issues.
To the fullest extent allowed by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
Limitation of liability
To the fullest extent allowed by law, The Energy Insight Pilot and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost savings, lost data, lost profits, or utility charges, even if we have been told those damages are possible.
Our total liability for any claim related to the service will not exceed the greater of zero dollars or the amount you paid us for the service during the 12 months before the claim. If a state does not allow a limitation like this, the limitation applies only to the extent allowed by that state's law.
Indemnity
You agree to defend, indemnify, and hold harmless The Energy Insight Pilot and its operators from third-party claims, losses, and reasonable costs that arise from your misuse of the service, your violation of these Terms, or your use of a utility account without proper authorization.
Changes to these Terms
We may update these Terms as the pilot changes. For material changes, we will give at least 14 days notice by email, account-portal notice, SMS, or another reasonable method. Continued use after the effective date means you accept the updated Terms.
The initial archived version is available at Terms archive for June 14, 2026. Future updates will keep prior versions available when practical.
Termination
You may stop using the service at any time and may contact support to ask for account closure or data deletion. We may suspend or terminate access if you violate these Terms, if required for legal or security reasons, or if the pilot is changed, paused, or discontinued.
After termination, data handling follows the Privacy Policy.
Dispute resolution and governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. If you have a dispute, please contact support@energyinsightpilot.com first so we can try to resolve it informally. We will aim to respond within 30 days.
If a dispute is not resolved informally, you and we agree to resolve it through binding individual arbitration, not in a class, consolidated, or representative action. Either side may bring an individual claim in small claims court if the claim qualifies.
